Terms & Conditions of Use 

Welcome to Feasly! We’re excited to have you on our platform but before you start using Feasly, we need you to read and agree to follow these Terms.

Please read them and make sure you understand what you should and shouldn’t do. If you can’t agree to our Terms, then you can’t use our services.

Feasly’s Terms and Conditions of Use and Privacy Policy are our commitment as a platform service provider and your obligations as a customer.

In these Terms, when we say you or your, we mean both you and any entity or firm you’re authorised to represent. When we say Feasly, we, our or us, we mean Feasly Pty Ltd | ABN: 25 651 937 763.   When we say services, products or platform, we mean all the products and services we provide now or in the future.

Important Notice

The information, calculations and projections provided by Feasly are based on the data that is input by the user and are intended for information and planning purposes only. Please note:

  •  Accuracy of data: The accuracy and completeness of the analysis and projections generated by the platform are dependent on the accuracy and completeness of the information provided by the user. We do not verify or guarantee the accuracy of user-provided data.

  • No financial advice: The platform and any associated reports or analyses do not constitute financial, investment, legal, or tax advice. Users are advised to seek professional advice from a qualified financial advisor, accountant, or legal professional before making any financial or investment decisions based on the information provided by the platform

  •  Assumptions and estimates: The projections and recommendations generated by the platform are based on user inputs, certain assumptions and estimates, which may not hold true in all circumstances. Real-world results may vary significantly from the projections due to changes in market conditions, costs, interest rates, and other factors. 

Using Feasly

In this section, we explain how to subscribe to Feasly and use our services.

Eligibility to use the platform: To be a subscriber and to be able to make an account to use our services, you need to meet the following criteria:

 (a) you are at least 18 years old; and

(b) you have the right, authority, or capacity to enter into this agreement and use our services; and

(c) the information you provide to us is true and not misleading.

 If you do not meet these criteria, you must not make an account with us.

Creating an Account and Subscription: When you create an account and select a subscription with Feasly and accept these Terms, you become a subscriber. You will be the one responsible for paying for your subscription.

People invited to use Feasly: An invited user is a person invited to view and use Feasly services by an existing subscriber. If you’re an invited user, you must also accept these Terms including holding a valid account and subscription.

User roles and access: If you are the subscriber inviting others, you should understand the permissions and roles you’re granting invited users and the content you are giving them access to. This includes the transfer of ownership of a project or scenario you have created in Feasly.

Partner program: If you participate in our partner program, you will agree to additional Partner Terms supplied at the time of partnership.

The right to use our services: As a subscriber, we grant you the right to use our services (based on your subscription type, your user role and the level of access you’ve been granted) for as long as the subscriber continues to pay for the subscription until the subscription is terminated.

Subscriber role: As a subscriber, you take responsibility for fully controlling your subscription.
(a) You cannot transfer your subscription.
(b) You control access to a subscription. You decide who is invited to view what you’ve subscribed to and what kind of content access the invited user has. You can change or stop that access at any time.
(c) You’re responsible for resolving any disputes with any invited users.
(d) You’re responsible for all your invited users’ activity and content sharing. 

Rules of Use

Your responsibilities: You agree you will keep your information (including a current email address, and payment details) up to date. You’re responsible for providing true, accurate and complete information and for verifying the accuracy of any information that you use from our services for your legal, tax and compliance obligations.

No Account Sharing. You agree you will not share, sell, resell, rent, lease, or provide access to your Feasly Account to anyone else. Allowing someone, other than yourself to access your account will be deemed a breach of security and these Terms. We reserve all available legal rights and remedies to prevent unauthorised use of our services, including, but not limited to, technological barriers, IP mapping, and, in serious cases, directly contacting Internet Service Providers (ISPs) regarding such unauthorised use. Feasly reserves the right to bill you directly for additional subscriptions for all unauthorised users of your account and subscription, including backdated billing to the date of first unauthorised use.

When we introduce new or revised services: Since we’re always thinking about how to make Feasly the best it can be – we’ve got a team dedicated to it – we regularly expand our services. For new or updated services, there might be additional terms. We’ll let you know what those terms are before you start using those services. 

Subscriptions, Payments & Billing

Subscription: Unless you’re in a free trial or another offer period, you’ll need to pay for a subscription based on the pricing of your selected plan.

Feasly pricing plans: Your use of our services generally requires you to pay a subscription fee based on your subscription type (the subscription fee). The pricing plan consists of the subscription and subscription fees we offered you, including invoicing, payment, auto-renewal and cancellation terms. We may update or amend the pricing plan from time to time. The terms of the pricing plan form part of these Terms. As with any other changes to our terms, changes to the pricing plan won’t apply retrospectively and, if we make changes and you’re a subscriber, we’ll make every effort to let you know. Depending on your region, subscription fees may be inclusive or exclusive transactional taxes where relevant (like GST), as reflected in the pricing plan. 

30-Day Money Back Guarantee: Feasly sometimes offers new users a 30-Day Money Back Guarantee promotion which is subject to these terms. You will be eligible for the promotion if it is offered to you at the time you sign up to Feasly on the SignUp Account Page and you accept it and these terms.

 If this promotion applies to you and you are not satisfied with our platform within the first 30 days of your subscription, you are eligible for a full refund of the subscription fees paid on the following conditions:

(a) you have entered a feasibility project in the platform; and

(b) you have provided us with feedback/cancellation reason (so we can improve the platform).

 To initiate a refund, please contact our customer support team within the 30-day period. You can contact our customer support team by email or via the in platform Customer Support Hub. Refunds will be processed promptly, typically within 7 business days. This promotion applies only to the initial 30 day subscription period and does not cover any subsequent renewals or additional purchases. 

Promotional Free Trial subscriptions: Feasly sometimes offers various trial or other promotional subscriptions, which are subject to these terms except as otherwise stated in the promotional offers. You’ll be required to enter payment details at the time of sign-up. At the completion of a trial membership, your plan subscription will renew automatically and your credit card will be charged to begin your initial term. If you do cancel within the trial period, your subscription and billing will begin automatically at the end of the trial period. You can cancel your trial at any stage before the last day of the specified trial period and you will not be billed. 

Subscription auto-renewals: All Feasly subscriptions will auto-renew unless cancelled before the renewal date.

Changing your subscription: If you make changes to your subscription the changes will apply to the next subscription renewal period.

Authorised payments: You authorise us to process your subscription fee payments on a recurring basis using the payment method you provide to us. You can manage your payment method at any time in your Feasly Account.

Importance of timely payments: To continue accessing our services, you need to make timely payments based on the pricing plan you selected. To avoid delayed or missed payments, please make sure we have accurate payment information. If we don’t receive timely payments, we may suspend access to your subscription until the payment is made.

Promotional codes: Feasly may, in its sole discretion, create promotional codes that may be redeemable for account credit or discounted services. Promotional codes may not be duplicated, sold or transferred in any manner, or made available to anyone but their intended recipient. Feasly at its sole discretion can redeem or refuse promotional codes at any time, for any reason.

Additional services: Depending on where you’re based and how you use our services, you may be able to take advantage of additional services that Feasly offers. These might incur an additional fee that we’ll let you know about when you sign up for those services. 

Payment & Billing 

You agree to pay Feasly the subscription fees associated with your selected Plan subscription.

Your subscription will be charged in accordance with the billing terms and billing date in effect at the time you selected your subscription plan; unless you have been notified of a fee change (refer to section below regarding Fee Adjustments).

To allow payment for the initial term of a Plan, valid credit card information is due at the time of purchase.

You can view and download your tax invoices in your Account section.

Unless otherwise stated, all amounts, including out-of-pocket expenses, expressed and described on or in connection with the Terms, are listed in Australian Dollars (AUD) and are GST exclusive.

You must make payment before you can commence using the platform.

Annual Plan subscriptions are billed in full upon purchase. The renewal term for annual subscriptions will be due and immediately payable in full as of the first day of that renewed term unless you cancel your subscription in your Feasly Account.  That is, unless you cancel your account before the end of your subscription period, your subscription will rollover for another term equal to the first term.

Monthly Plan subscriptions are billed monthly upon purchase. The renewal term for monthly subscriptions will be automatic and will be due and immediately payable in full as of the first day of that renewed month and at the end of each term thereafter unless you cancel your subscription in your Feasly account.   

Subscription discounts may be available if you purchase multiple months upfront i.e Annual subscription, as part of certain promotions which may include additional terms and conditions presented with the offer, or where limited by law. Any promotional subscription discounts that may be offered will be applied at the time of purchase.   

Your Plan usage is immaterial:  The charge remains for each term no matter what your usage is during that term. In other words, even if you do not use the plan benefits you will be responsible for any subscription fees until you cancel the subscription or it is otherwise terminated.   

Credit card details: Feasly uses a third-party payment provider, Chargebee and the payment gateway provided by Stripe – your card details will be held by Stripe. Stripe works directly with card providers to update the details of replaced cards (E.g. if a card goes out of date or is lost and then replaced); you should not assume that when your card expires your subscription is immediately cancelled.   

Purchase and billing date: If your purchase date is on the 29th through 31st day of any month, the billing date for renewals in months with fewer days will fall on the last day of the month. Feasly may adjust the billing date in subsequent renewal periods without notice. This will be reflected by a charge to your account on a prorated basis according to the number of days that have passed since the billing date of the latest renewal charge. Unless otherwise notified in advance by Feasly under the Terms, the renewal charge will be equal to the original purchase price for the Plan.

Cancellation/ Refunds

You can cancel your subscription at any time in your Feasly Account. If you cancel your subscription, your cancellation will be effective on the next renewal date (which may be at the end of the relevant year, or relevant month – depending on your plan type).  You may also terminate your subscription in accordance with the clauses relating to termination below. 

 Feasly will not issue refunds if you cancel your subscription mid-term; On cancellation, you will still have access to your Feasly account until the next renewal date when the cancellation will take effect. To be clear, if cancelling an annual subscription plan mid-term you will not be entitled to a refund, you will be entitled to continue access to Feasly until cancellation takes effect.  

Fee Adjustments

Feasly may increase its fees for any Plan subscription effective the first day of a renewal term by giving you notice of the new fees at least thirty (30) days before the beginning of the renewal term.

 If you do not cancel the subscription, you shall be deemed to have accepted the new fee for that renewal term and any subsequent renewal terms (unless the fees are increased in the same manner for a subsequent renewal term). Reductions in fees become effective on the next renewal term without any pro rata for the period covered under the prior fee schedule. 

Security, Data Use & Privacy

We take security and your data very seriously. Feasly uses your data to provide our services to you. Our privacy policy is an important part of these terms and describes in more detail how we deal with personal data, like your name and email address, your development project and land address.

Playing your part to secure your data: You have an important part to play by keeping your login details secure, not letting any other person use them, and making sure you have strong security on your systems. You’re also responsible for protecting your username and password from getting stolen or misused. Our service has minimum password standards but you will ensure that passwords are very strong and not easily guessable. If you realise there’s been any unauthorised use of your password or any breach of security to your account or email address linked to your account, you need to let us know immediately. You also agree not to use free-form fields in any of Feasly’s systems or services to store personal data (unless it’s a field explicitly asking for personal data - like a first name or a last name), credit card details, or bank account details.

Use of your data: We respect your privacy and take data protection very seriously. In addition to these terms, our Privacy Policy sets out in detail how we process your data that you enter into Feasly, like your name and email address.

Sharing your data: As part of our service, you can share some of your platform data with subscribers you choose to share with. You take full responsibility for shared data and managing visibility and access levels.

 Anonymised statistical data: When you use our services, we may create anonymised statistical data from our subscribers and usage of our services, including through aggregation. Once anonymised, we may use it for our purposes, such as to provide and improve our services, to develop new services or product offerings, to identify business trends, and for other uses, we communicate to you.

Security safeguards: We’ve invested in technical, physical and administrative safeguards to do our part to help keep your data safe and secure. While we’ve taken steps to help protect your data, no method of electronic storage is completely secure and we cannot guarantee absolute security. We may notify you if we have reason to believe that someone has accessed (or may be able to access) your account without authorisation and we may also restrict access to certain parts of our services until you verify that access was by an authorised user.

Retention of your data: Once a subscription is terminated by you or us, it is archived and the data submitted or created by you is no longer available to you. We retain it for some time consistent with our data retention policy, during which, as a subscriber, you can reactivate your subscription and once again access your data by paying the subscription fees. We retain data in case you need it as part of your record retention obligations, but you can get in touch with us to have your data removed completely if you wish.

Account security features: We may introduce security features to make your account more secure, such as multi-factor authentication. Where we make the use of security features optional, you’re responsible (meaning we’re not liable) for any consequences of not using those features. We strongly encourage you to use all optional security features.

User Data

Your user data means any information and content that you submit to or use with the Platform.

 Feasly will not on-sell user data

  • Feasly does not claim ownership of your user data. Feasly makes no guarantees about the user data and Feasly does not endorse or accept any responsibility for your user data.

  • We don’t own your user data but you grant us a licence to use, transmit, store, analyse, and back up all data you submit to us through our services, including personal data of yourself and others, to enable you to use our services; allow us to improve, develop and protect our services; create new services; communicate with you about your subscription; and send you information we think may be of interest to you based on your marketing preferences.

  • You are solely responsible for your user data. You assume all risks associated with the use of your user data, including any reliance on its accuracy or completeness.

  • You represent and warrant that your user data does not violate any third party rights.

  • By posting content onto the platform, you expressly grant to Feasly and its successors an irrevocable, non-exclusive, transferrable, sub-licensable, perpetual, royalty-free, worldwide license to broadcast, republish, up-load to a third party, transmit, post, distribute, publicly display, and otherwise use and exploit your de-identifiable user data. You hereby irrevocably waive any claims and assertions of moral rights concerning your user data.

  • Feasly reserves the right to review, remove or amend any user data. 

Intellectual Property

What we own: We own everything we’ve put into our services unless otherwise stated and excluding content owned by others. This includes rights to the technology, content, design, compilation, and look and feel of our services. It also includes rights in all copyrighted works, trademarks, designs, inventions, and other intellectual property. You agree not to copy, distribute, modify or make derivative works of any of our content or technology or use any of our intellectual property rights in any way not expressly permitted by us.

Using Feasly’s content: You may read and copy and download the information on Feasly for your own needs but you may not publish, resell or sub-licence it. To the extent allowed by law, Feasly makes no guarantees, representations or warranties about the accuracy or correctness of any of the information on Feasly. 

Linking to Feasly

  • You may link to Feasly’s website home page, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

  • You must not link to Feasly in any way that would suggest any form of association, approval or endorsement on our part where none exists unless express permission is given by Feasly or under our Partnership Program.

  • The site from which you are linking must comply in all respects with the standards set out in our acceptable use policy below.

  • You must not establish a link from any site that is not owned by you. We reserve the right to withdraw linking permission without notice.

  • Where the Platform contains links to websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. 

Alpha & Beta Terms

Feasly is always evolving. From time to time, we may make early-stage, experimental, or pre-release versions of our platform—or features within it—available to users as Alpha or Beta Access (“Beta Platform”).

By using the Beta Platform you agree to the terms below:

What Beta Means

The Beta Platform is a work in progress. It may be incomplete, undergo frequent changes, or be removed at any time. It’s provided so you can test new ideas with us, offer feedback, and help shape where we go next. You use it entirely at your own discretion and risk.

Who Can Use It

Access to the Beta Platform may be by invitation or opt-in only. We may limit access, eligibility, or duration at any time. We reserve the right to suspend or revoke Beta access without notice.

Nature of Beta Platform and Features

The Beta Platform and Beta Features are in development and may not function as intended. They may contain errors, bugs, or other issues and are provided “as is” and “as available,” without warranties of any kind. Feasly may significantly change or discontinue Beta Platform or feature access at any time, and such versions may never be released commercially.

Specific Alpha or Beta Terms

If you are invited to use, or access, the Beta Platform (including any Alpha or Beta version of a feature or the broader platform), we may provide you with additional written terms, conditions, or guidance specific to that release. These may include limitations, known issues, warnings about functionality, expected behaviours, or other information about likely or potential outcomes.

These specific Alpha or Beta terms will apply in addition to this clause. If there is any inconsistency, the specific terms will take precedence to the extent of that inconsistency.

Feedback

If you access the Beta Platform or any Beta Features, you may be asked to provide feedback, suggestions, or report issues . You agree that all Feedback becomes the sole property of Feasly and may be used by us for any purpose, including improving our services, without compensation or attribution.

Confidentiality

Unless we say otherwise, your access to the Beta Platform is confidential. That includes the features, your experience, and any related materials. You agree not to share or publicly discuss anything related to the Beta Platform without our prior written consent.

Data and Privacy

We may monitor how you use the Beta Platform, including feature usage and performance data, to help us improve the experience. Any personal data collected is handled in accordance with our Terms of Use.

Liability

We don’t provide dedicated support for Beta Platform features, and we’re not liable for any loss or disruption caused by their use. You accept full responsibility for your use of any beta tools or content, and acknowledge they may never become part of the live platform.

Opt-Out and Termination

You can stop using the Beta Platform at any time in line with Subscriptions, Payments & Billing terms. We may also turn it off at our discretion.

Apps & Third Parties

To help make your Feasly experience more impactful, the Feasly ecosystem includes apps and other products and services made available by trusted partners. 

  • Third-party terms and descriptions: Third-party products are subject to terms and conditions and privacy notices set by their providers. These include important things like pricing, refund policies, and how the provider will use the data that you make available to them. Be sure to read and make sure you agree to their terms and conditions and understand their approach before you connect with them. The descriptions of third-party products that we publish, and any associated links, have been provided to us by the providers. While we make reasonable efforts to check the accuracy of the descriptions, the providers are solely responsible for any representations contained in those descriptions. We don’t endorse or assume any responsibility for third-party products.

  • Feasly works with several partners and affiliates whose websites are linked with Feasly and are controlled by parties other than Feasly.

  • Feasly is not responsible for and does not endorse or accept any responsibility for the availability, contents, products, services or use of any third-party website, any website accessed from a third-party website or any changes or updates to such sites. Feasly makes no guarantees about the content or quality of the products or services provided by such sites. If you have purchased a package that includes any third-party services, the third party may contact you by email and/or phone with instructions on how to access your benefits and to keep you informed of their services. You may be required to accept additional terms located on the third-party websites. 

  • Certain services made available on the Feasly Platform may be delivered by third parties. By using any product, service, or functionality originating from the Feasly Platform, you are allowing Feasly to share information with any third party with whom Feasly has a pertinent contractual relationship – any information necessary to facilitate its provisions of products, services, or functionality to you. 

Confidential Information

We take reasonable precautions to protect your confidential information and expect that you’ll do the same for ours. While using our services, you may share confidential information with us, and you may become aware of confidential information about us. You and we both agree to take reasonable steps to protect the other party’s confidential information from being accessed by unauthorised individuals. You or we may share each other’s confidential information with professional advisors, legal or regulatory authorities if required to do so. 

Maintenance, Downtime & Data Loss

We try to minimise any downtime and access issues, but sometimes it’s necessary so we can keep our services updated and secure.

  • Availability: We strive to maintain the availability of our services, and provide online support. Response times will depend on the severity of the issue. On occasion, we need to perform maintenance on our services, and this may require a period of downtime. We try to minimise any such downtime. Where planned maintenance is being undertaken, we’ll attempt to notify you in advance but can’t guarantee it.

  • Access issues: You know how the internet works – occasionally you might not be able to access our services and your data. This might happen for any number of reasons, at any time.

  • Data loss: Data loss is an unavoidable risk when using any technology. We have backup servers in place, however, depending on the severity of the issue, you may lose some of your data.

  • No compensation: Whatever the cause of any downtime, access issues or data loss, your only recourse is to discontinue using our services.

  • Problems and support: If you have a problem, we have several customer support channels available both on the website and platform.

  • Modifications: We frequently release new updates, modifications and enhancements to our services, and in some cases discontinued features. Where this occurs, we’ll endeavour to notify you where practical (for example, by email, on our blog, or within our services when you log in). 

Reasonable Use Policy

Feasly services are subject to Reasonable Use to prevent exploitation, fraud, and abuse of our plans and services. Our services are subject to reasonable use, which under these Terms, is use that Feasly deems as reasonable within our sole discretion and judgment. You must comply with this Reasonable Use Policy when accessing Feasly services. This includes: 

  • You must only use Feasly for your own lawful internal business purposes.

  • You must only use Feasly for lawful purposes only.

  • You must not use Feasly:
    (a) If your use breaches any applicable law or regulation whether local, national or international.
    (b) If your use is unlawful or fraudulent.
    (c) If your use is sharing anything that may be offensive, violates any law, or infringes on the rights of others.
    (d) If your use is to resell, lease or provide our services in any way not expressly permitted through our services.
    (e) If your use harms or could harm minors in any way.

  • You must not modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer or extract the source code of any part of our services.

  • You must not repackage, resell, or sublicense any leads or data accessed through our services.

  • You must not act in a manner that is abusive or disrespectful to a Feasly employee, partner, or other Feasly customer. We will not tolerate any abuse or bullying of our Feasly employees in any situation and that includes interaction with our support team.

  • You must not use Feasly to send spam materials to other people.

  • You must not use Feasly to post any contributions which contain material that is defamatory, obscene, offensive, hateful, inflammatory, deceptive, likely to harass, upset, embarrass or impersonate any person or which is sexually explicit, promotes violence or any form of discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age, or which infringes any third party intellectual property rights or other rights.

  • You must not use Feasly to knowingly introduce or transmit viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.

  • You must not gain, or attempt to gain, unauthorised access to the platform, the server on which the platform is stored or any server, computer or database connected to Feasly.

  • You must not attack the platform via a denial-of-service attack or a distributed denial-of-service attack or do anything that could disable or impair the Platform.

  • If you breach these terms contained in this Acceptable Use Policy, your right to use and access Feasly will cease immediately. 

Termination

How can you cancel your Subscription?

In your Feasly Account. You can cancel your plan at any time in Your Feasly Account. If you cancel, your cancellation will be effective on the next renewal date (which may be at the end of the relevant year, or relevant month – depending on your plan type) and you will continue to have access to your subscription plan through the end of that period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial subscription periods.

For breach. You may terminate your subscription if we fail to remedy a material breach of these Terms within 10 days of you giving us notice of the breach in writing.

How can we cancel your subscription? We can terminate your subscription at any time by providing you with at least 30 days written notice. We can terminate or suspend your access immediately without prior notice if:

  • you fail to remedy a material breach of these Terms within 10 days after we give you notice of the breach;

  • you fail to pay overdue fees; or

  • you go into liquidation, administration, insolvency, bankruptcy or such other similar arrangement with creditors.

What happens on Termination? Unless otherwise specified, termination is effective on the last date of your subscription plan. If you have not provided notice before the end of your subscription plan end date, your plan will automatically continue for a further period of the same duration as the previous one . On the date that termination of your subscription plan is effective your use of our platform will cease and you and any invited users will not be able to access your materials and you will be locked out of your account. As such, please ensure you download what you need before termination.

Liability & Indemnity

Liability

If you accept these Terms, they do not exclude, restrict or modify the application of any part of the Australian Consumer Law (ACL).To the extent permitted by law, we provide no warranty and make no claim in relation to our performance, the performance of Feasly, or any service associated with Feasly including any third-party applications or websites that can be accessed through our platform. 

Our liability to you for any non-compliance with a statutory guarantee, or loss or claim arising out of or in connection with the supply of goods or services under these Terms, or any breach by us of these Terms however arising (including negligence), is limited to: the resupply of the service (as applicable); or the cost of re-supplying the service.  Where the ACL applies and there is a major failure in the services, we will provide you with another remedy as required by the ACL. 

To the extent allowed by law, representations, conditions, warranties and terms that would otherwise be expressed or implied in these Terms by general law, statute or custom are expressly excluded.

To the extent allowed by law, under no circumstances will we be responsible for any consequential or indirect loss, suffered by you or any third party in connection with the platform, our website or services or these Terms.

Indemnity to us and third parties.

You indemnify us, our staff and other third parties (Indemnified Parties) against any loss or claim suffered or incurred by the Indemnified Parties or any of them arising from your (and your invited users) negligence, misrepresentation, fraud, breach of law or breach of these Terms or the loss or misuse of your password and username. If the Indemnified Party caused or contributed to a loss or claim, then your liability is limited to the amount of the loss or claim which is directly attributable to your conduct. 

Disputes

As a subscriber, you are responsible for resolving disputes with your invited users.  If you have any questions, complaints or claims, most of your concerns can be resolved quickly and to everyone’s satisfaction by contacting our support team.

Other Terms

Events outside our control: We do our best to control the controllable. We aren’t liable to you for any failure or delay in the performance of any of our obligations under these terms arising out of any event or circumstance beyond our reasonable control. 

Relationship between the parties: Nothing in these terms is to be construed as constituting a partnership, joint venture, employment or an agency relationship between you and us, or between you and any other subscriber or invited user. You’re solely responsible for resolving disputes between you and any other subscriber or invited user. 

Assignment: You may not assign these Terms without our prior written consent.  We may assign or otherwise transfer the benefit of this agreement between us at any time. 

Changes to these terms: We sometimes will decide to change these terms of use. If we make changes, we’ll make every effort to let you know. You can keep track of changes to our terms by referring to the version and the date last updated at the top of the terms. Generally, we endeavour to provide you with 30 days’ notice of material changes before they become effective unless we need to make immediate changes for reasons we don’t have control over. When we notify you, we’ll do it by email or by posting a visible notice through our services. If a change isn’t material, we may not notify you. If you find a modified term unacceptable, you may terminate your subscription immediately and you will only pay to the date of termination. 

Enforcement of terms: If there’s any part of these terms that either one of us is unable to enforce, we’ll ignore that part but everything else will remain enforceable. 

Interpretation: Words like ‘include’ and ‘including’ are not words of limitation and where anything is within our discretion we mean our sole discretion. 

Notices: Any notice you send to Feasly must be sent to info@feasly.com.au. Any notices we send to you will be sent to the email address you’ve provided us through your subscription. 

Jurisdiction: these Terms are governed and construed by the laws of Queensland, Australia.
